PRIVACY POLICY

We recognise that your privacy is very important to you and that it is your right to control your personal information. We know that providing personal information is an act of trust and we take that trust seriously.

Protection of personal data and their processing

 

1.1. The contracting parties have agreed that the buyer, if he is a natural person, shall notify the seller of his / her surname, permanent address including postal code, telephone number, e-mail address. If the seller also processes other personal data of the buyers, it processes them to the extent necessary to fulfill the obligations arising from the contract of sale. The Buyer provides personal data to the Seller voluntarily for the purpose of fulfilling his obligations under the Purchase Contract and further communication with him. Without their delivery, the seller cannot properly perform the contract with the buyer and therefore will not be able to close it with the buyer. The purpose of processing this personal data is to issue a tax document, pre-contractual relations, identification of the buyer, order confirmation by telephone or e-mail, delivery of goods, loyalty programs for customers, realization of marketing activities, information about events, news and discounts.
 
1.2. The Seller processes personal data of the persons concerned for the purposes of loyalty programs and for marketing purposes with the consent of the person concerned in accordance with § 11 of the Act. no. 122/2013 Coll. on the protection of personal data, as amended. The person concerned expresses his / her consent to the processing of personal data when ordering goods via the online store www.bruuder.eu or in any other appropriate manner.
 
1.3 The Seller hereby notifies the Buyer that under the provisions of § 10 para. 3 (a) b) of Act no. 122/2013 Z.z. on the Protection of Personal Data as amended, the Seller, as the operator in the process of concluding the Purchase Contract, will process the Buyer's personal data without his consent as the data subject, since the processing of the Buyer's personal data will be performed by the Seller in pre-contractual relations with the Buyer and the processing of the Buyer's personal data is necessary for performance a contract of sale in which the buyer acts as one of the parties.
By ticking the appropriate box before sending the order, the buyer can express his / her consent in accordance with § 11 para. 1 of the Personal Data Protection Act, that the Seller process and store his / her personal data, in particular those listed above and / or which are necessary for the Seller's activity of sending and processing information about new products, discounts and promotions on the goods offered all their information systems for sending information on new products, discounts and promotions on the goods offered. The Buyer grants the Seller this consent for a definite period of time until the purpose of processing the Buyer's personal data is fulfilled. The Seller shall ensure the immediate liquidation of the Buyer's personal data upon completion of the processing purpose. The Buyer may withdraw the consent to the processing of personal data at any time in writing. The consent shall expire within 1 month of receipt of the withdrawal of consent by the buyer.
 
1.4. The buyer has the right and the possibility to update personal data directly in the on-line mode on the website of the online store, in the section my account immediately after login.
 
1.5. The Seller declares that in accordance with § 6 para. 2 (a) c) The personal data will be acquired only for the purpose specified in 1.1., 1.2. and 1.3. these conditions.
 
1.6. The Seller declares that in accordance with § 6 para. 2 (a) e) ZnOOÚ shall ensure that personal data are processed and used exclusively in a manner that corresponds to the purpose for which they were collected.
 
1.7. The Seller declares that in accordance with § 6 par. 2 (a) i) ZOOO will process personal data in accordance with good morals and will act in a manner that does not contradict ZnOOU or other generally binding legal regulations and will not circumvent them.
 
1.8. The Buyer has the right to request from the Seller in writing:
1. Confirm whether or not personal information about it is processed
2. in a comprehensible form, information on the processing of personal data in the information system to the extent of:
(a) the identification details of the seller a  nd the seller's representative, if any, \ t
(b) intermediary identification data; this does not apply if the Seller does not proceed in accordance with Section 8 of the Act when acquiring personal data,
(c) the purpose of the processing of personal data;
d) the list of personal data or the scope of personal data pursuant to § 10 par. 4 of the first sentence

(e) supplementary information which, in the light of all the circumstances and conditions for the processing of personal data, is necessary for the purchaser to guarantee its rights and the interests protected by law, in particular by providing information about the voluntary nature or the obligation to provide the personal data requested; if the Seller acquires the Buyer's personal data on the basis of the Buyer's consent pursuant to Section 11 of the SOPA, it shall also notify the Buyer of the time of the consent, and if the Buyer is obliged to provide personal data from a directly enforceable act of the European Union, an international treaty binding the Slovak Republic or a law , the seller informs the buyer of the legal basis that imposes this obligation and notifies the buyer of the consequences of refusing to provide personal data, third parties, if it is presumed or obvious that they will be provided with the personal data, that personal data will be made available to them, the form of publication if personal data are to be disclosed, third countries if it is foreseen or apparent that the transfer of personal data to those countries will take place.


3. in a comprehensible form, accurate information on the source from which it has obtained its personal data for processing;


4. in a generally comprehensible form, a list of its personal data which are subject to processing;


5. the repair or liquidation of your incorrect, incomplete or outdated personal data subject to processing;


6. the liquidation of its personal data whose processing ends; if they are subject to the processing of official documents containing personal data, they may request their return,


7. Liquidation of its personal data that is being processed if there is an infringement;


8. Blocking of its personal data due to withdrawal of consent before expiry of its validity if the Seller processes personal data on the basis of the Buyer's consent.


 1.9. Buyer's right under point 1.8. Paragraphs 5 and 6 of these Terms and Conditions may be limited only if such restriction results from a special law or its application would violate the protection of the buyer, or the rights and freedoms of other persons would be violated.

1.10 The Buyer has a free written request to the Seller to object to the processing of his / her personal data that he / she considers to be or will be processed for the purposes of direct marketing without his / her consent and to request their liquidation, use of the Buyer's name, surname and address direct marketing in postal service, or providing the buyer's title, name, surname, and address for direct marketing purposes.

1.11 On the basis of a written request or in person, if the matter cannot be deferred, the Buyer has the right at any time to object to the processing of personal data in the cases pursuant to Section 10 Para. 3 (a) (a), (e), (f) or (g) ZnOOU by giving justified reasons or by providing evidence of unlawful interference with its rights and interests protected by law, which are or may be harmed by such processing of personal data; if this is not precluded by legitimate reasons and it is shown that the Buyer's objection is justified, the Seller is obliged to block and dispose of the personal data that the Buyer has objected to without delay as soon as circumstances permit.

1.12 Furthermore, the Buyer has the right, in writing or in person, if the matter is not deferred, and has the right to object to the Seller at any time and not to comply with a Seller's decision that would have legal effects or significant impact if it is based solely on the processing of its personal data. The Buyer has the right to ask the Seller to review the issued decision by a method different from the automated form of processing, whereby the Seller is obliged to comply with the Buyer's request, so that the Authorized Person will play a decisive role in reviewing the decision; the Seller shall inform the Buyer within 14 days of the manner of examination and the findings of the findings. The buyer does not have this right only if it is provided for by a special law that provides for measures to safeguard the buyer's legitimate interests, or if, in the context of a pre-contractual relationship or during the existence of contractual relationships, the seller has issued a decision to comply with the buyer's request, or if other appropriate measures to safeguard the buyer's legitimate interests.

1.13 If the buyer exercises his right in writing and the content of his application indicates that he exercises his right, the application shall be deemed to have been filed under this Act; the application submitted by electronic mail or fax shall be delivered by the Buyer in writing within three days from the date of its dispatch, in person orally to the minutes from which it must be clear who has exercised the right, what is claimed and when and who drew up the minutes, his signature and signature of the Buyer; the Seller is obliged to hand over a copy of the Minutes to the Buyer, to the Agent pursuant to Clause 1 or 2 of this paragraph of these Business Terms and Conditions, the Seller is obliged to submit the request or Minutes to the Seller without undue delay.


 1.14 If the Buyer suspects that his / her personal data is being processed illegally, he / she may submit to the Office for Personal Data Protection of the Slovak Republic a proposal to initiate the proceedings on the protection of personal data.


 1.15 If the Buyer does not have full legal capacity, his / her rights may be exercised by a legal representative.

1.16 If the buyer does not live, a close person may exercise his rights under this law.

1.17 Buyer's request under para. 1.8. points 1 to 3, 5 to 8 of these Terms and Conditions and para. 1.10 to 1.12. these Terms and Conditions shall be handled by the Seller free of charge.

1.18 Buyer's request under para. 1.8. paragraph 4 of these Business Terms and Conditions shall be handled by the Seller free of charge, except for the amount that cannot exceed the amount of purposefully spent material costs associated with the making of copies, the purchase of technical media and the sending of information to the Buyer, unless otherwise provided by a separate Act.

1.19. The Seller is obliged to make a written request of the Buyer in accordance with paragraphs 1.17. and 1.18. of these Terms and Conditions no later than 30 days from the date of receipt of the request.

1.20 Restriction of Buyer Rights under para. 1.9. of these Business Terms and Conditions the Seller shall notify the Buyer and the Office for Personal Data Protection of the Slovak Republic in writing without undue delay.

1.21. The Seller declares that in accordance with § 15 par. 1 (a) b) ZnOOÚ processes the Buyer's personal data for the purposes set out in point 1.3. these conditions through the following intermediaries: Slovak Parcel Service s.r.o.,  Senecká cesta 1, 900 28 Ivánka pri Dunaji.

As a buyer, I am aware of the fact that I am entitled to withdraw the above-mentioned approvals at any time in writing.

As buyer I declare that I was in accordance with § 15 par. 1 informed about the conditions of processing of personal data by the operator, which are published on the website www.bruuder.eu


Consent to personal data processing - loyalty programs


If the buyer requests registration or he / she expresses his / her consent to be included in the loyalty program, at the same time he / she will give his / her consent under § 11 of Act no. 122/2013 Coll. on the Protection of Personal Data as amended by later regulations, with the processing of their personal data contained in the applications or in applications for loyalty programs by BRUUDER s.r.o., registered office: Azalková 8, Bratislava - mestská časť Ružinov 821 01, Company ID: 51245035 for the purpose of keeping the loyalty program. At the same time, I agree that my personal information is provided to third parties.


I declare that I was in accordance with § 15 para. 1 informed about the conditions of processing of personal data by the operator, which are published on the website www.bruuder.eu


Consent to personal data processing - marketing


I hereby grant consent pursuant to § 11 of Act no. 122/2013 Coll. on Personal Data Protection, as amended by later regulations, with the processing of my personal data in the scope of email address by BRUUDERr s.r.o., registered office: Azalková 8, Bratislava - mestská časť Ružinov 821 01, IČO: 51245035 for marketing purposes. At the same time, I agree that my personal information is provided to third parties. I declare that I was in accordance with § 15 para. 1 is informed about the conditions of processing of personal data by the operator.
